The following Terms and Conditions apply to the use of this Web site as well as all transactions conducted through the site.

  • RESERVATION INFORMATION AND RISK ACKNOWLEDGMENT By advancing payment to Balanced Rock Foundation, the depositor therefore agrees to be bound by the below terms and conditions. All trip participants must complete a trip application/Acknowledgement of Risk Agreement and medical form. Enrollment in the trip is contingent upon the receipt of completed copies of the above forms and the appropriateness of the participant for the activites of the course. YOUR RESPONSIBILITIES - Medical considerations: If you have any medical or psychological conditions, it's very important you let us know well before departure so that we can make extra arrangements if necessary. - Trip leaders have the right to disqualify anyone at any time during the trip if they feel the trip member is mentally or physically incapable to continue and/or if a trip member's continued participation jeopardizes the group's or his/her own safety. Under these circumstances refunds are not given. - Hospital facilities for serious problems are often unavailable, and evacuation can be prolonged, difficult and expensive. Balanced Rock Foundation assumes no liability regarding provision of medical care. By signing the Assumption of Risk Agreement, you agree to pay for emergency evacuation and emergency medical care. Your obligations as a trip member by participating in a Balanced Rock course, you assume certain obligations to Balanced Rock Foundation and the other trip members. It is your responsibility to: o Prepare for the trip by familiarizing yourself with the trip itinerary and trip preparation materials sent by Balanced Rock. o Bring appropriate gear and clothing as advised by Balanced Rock. o Follow considerate social behavior with other trip participants and respect their habits. Balanced Rock Foundation reserves the right to decline to accept or retain any person as a tour participant should such person's behavior, health or mental condition impede the operation of the trip. OUR LEGAL LIMITATIONS-PLEASE READ CAREFULLY IF WE CANCEL A COURSE Balanced Rock Foundation reserves the right to cancel a course for force majeure or any other circumstances beyond our control. We also reserve the right to cancel any trip if sign-up is inadequate to make the trip economically feasible for us to operate. If this happens, we give a full refund of tuition. However, Balanced Rock Foundation is not responsible for additional expenses incurred by you in preparing for the trip (e.g., non-refundable air tickets, gear or medical expenses). REFUND POLICY You may cancel your registration and receive a full refund minus a $50 registration fee 30 days or more before the start date of your course. Cancellation made less than 30 days prior to the program receives no refund on tuition, but can receive credit toward another course date. PARTICIPANT ACKNOWLEDGMENT OF RISKS In consideration of the services of Balanced Rock Foundation, their officers, agents, employees, volunteers, participants, and directors, and all other persons or entities associated with those businesses (hereinafter collectively referred to as ?BR?) I agree as follows: Although BR has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, BR has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. BR does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The risks include, among other things: Slipping and falling; falling objects including rocks; water hazards and accidental drowning; exhaustion; exposure to temperature and weather extremes which could cause hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; and exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; equipment failure; and improper lifting or carrying. Furthermore, BR employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction. I am aware that participating in BR programs entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks. I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the staff of BR has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity. I have carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children.
